Terms and conditions of use (T&C)

 

These terms and conditions set out the conditions of use of the website accessible at Puzzling Biodiversity (hereinafter referred to as the "Website"), created by the Mosaic Service Unit under the joint supervision of the Muséum national d'Histoire naturelle (MNHN) and Sorbonne Université (SU) and by the Fondation pour la Recherche sur la Biodiversité (FRB) and Carbone 4 (C4), and put online by the Muséum national d'Histoire naturelle (hereinafter referred to as the "Website Administrator").

By accessing the Site, you become a User. Browsing the Site and/or registering for a service implies the User's express and unreserved acceptance of these G.C.U. and his/her undertaking to comply with them.

 

Information contained on the website

This site is a collection of assessments (ranking of management practices by biodiversity experts), accessible free of charge, for which you need to create an account if you wish to access the assessment paths. Its aim is to assess biodiversity gains associated with a taxonomy of biodiversity-friendly management practices recommended for a socio-ecosystem. The site collects the opinions of biodiversity experts on the ranking of practices, and each expert can enter a ranking by socio-ecosystem. The intention is to assess the consensus and/or dissensus between experts on the ranking of biodiversity management practices in relation to the biodiversity gain that can be expected.

No information contained on the site may be construed as having any contractual value whatsoever.

The information on the services or the objects of the participations or any other information contained on the site comes from documents considered reliable on the day they were put online.

All information, whether of a practical or scientific nature, is of an exclusively indicative nature and without any commitment on the part of the Site Administrator.

Any information contained on the site, which does not come under the classifications made by the biodiversity experts (the respondents), may be modified at any time and without prior notice by the Site Administrator.

The information contained on the Puzzling Biodiversity site does not constitute an offer of services or products or a commercial solicitation of any kind whatsoever, nor does it constitute a recommendation or advice. The Site Administrator may not be held liable for any decision made or not made on the basis of any information contained on the Site, nor for any use that may be made thereof by a third party. The Site Administrator shall not be held liable for such information.

Users of this site are responsible for taking all appropriate measures to protect their own data and/or software from contamination by any viruses circulating on the Internet. In general, the Site Administrator declines all responsibility for any damage that may occur during consultation of this site.

 

 

Acceptance and amendment of the Terms and Conditions of use (T&C) and the Website

Access to and use of the Site are subject to acceptance of and compliance with these Terms and Conditions of use (T&C). By browsing the Site, whatever the technical means of access and the terminals used, the user is presumed to be aware of these T&C. and to accept their terms without reservation. These T&C apply, as necessary, to any variation or extension of the Site on existing or future social and/or community networks.

The T&C may be amended at any time by the Site Administrator. The User is therefore advised to refer to the latest version of the T&C, which may be consulted at any time on the site, before browsing. In the event of disagreement with the T&C, the User may not use the site.

 

Protection of site content

This Site Puzzling Biodiversity and all its constituent elements whatsoever are the property of the Site Administrator. They are protected by copyright and intellectual property law (with the exception of individual classifications made by users). Their sharing, distribution and communication by any means are authorised, as is their adaptation and transformation under the following conditions: the work must be credited, include a link to the licence and indicate the modifications made. Unless specifically agreed, under no circumstances will it be suggested that the Mosaic Service Unit endorses the use or manner in which the works are used.

 

Reproduction of all or part of this Site on any electronic medium whatsoever is strictly prohibited without the express authorisation of the publication directors. Reproduction of this site on paper is authorised for personal, associative or professional purposes and subject to compliance with the following three (3) cumulative conditions:

·         free distribution ;

·         respect for the integrity of the documents reproduced: no modifications or alterations of any kind;

·         clear and legible citation of the source indicating the name "Puzzling Biodiversity", the Internet address of the Site: "Puzzling Biodiversity" and the mention: "©< Puzzling Biodiversity> - Reproduction prohibited - All rights reserved".

Any distribution or use of the Site's content and information for commercial or advertising purposes is strictly prohibited. For any other use, the request must be sent to the Site Administrator via the contact form.

The databases and/or data files are protected by special provisions introduced by Law no. 98-536 of 1 July 1998 on the legal protection of databases. It is forbidden to re-use them without the express prior authorisation of the Site Administrator.

 

Access to the site and use of content

The Site Administrator authorises all Users, in accordance with the present conditions and the rules of use on the Internet, to consult this Site free of charge, for information purposes only, solely for their personal and private use and to the exclusion of all commercial purposes. All costs associated with access to the Site, whether hardware, software or Internet access costs, are the sole responsibility of the User

Users will be able to create a personalised account on the Site, enabling them to access the services of interest to them, after identifying themselves by means of their login details. They therefore undertake to provide, maintain and regularly update accurate, complete and up-to-date information.

 

Services provided

1/ Creating a user account

Users can create an account in order to identify themselves and complete an assessment path.

They can :

·         Ranking the most biodiversity-friendly practices by socio-ecosystem

·         Evaluate the influence of contextual factors and interactions between practices on biodiversity gains

·         Comment on the taxonomy of practices and the quality of the proposals made

·         Comment on the data collection protocol and give feedback on how they feel about [AP2] the assessment method

Once the registration form has been completed, the User will have a personal dashboard, which will summarise :

·         His/her personal information from the registration form;

·         Its rankings and progress in current evaluation campaigns

Some of the above-mentioned information put online by the User will be made public by default, except for <OPTIONAL EXCEPTIONS: Email, tel...>.

The only information that will be made public is the list of participants, subject to their prior agreement. The individual rankings will only be made public after anonymisation and in the form of a database. The reference rankings, compiled from the individual rankings, will be made public. No personal information linking the User to his/her answers will be accessible to anyone outside the Site Administrator. We guarantee data anonymisation so that no respondent can be identified from the database.

Registration is free and must meet the following conditions:

·         All information provided when registering and creating a profile must be authentic and accurate;

·         Registration must be for personal, non-commercial use;

·         Use of the Site must not infringe any applicable law or regulation.

·         The user undertakes not to make any rankings whose purpose would be to distort the results in order to restrict the success of the project.

Any account and/or profile may be deleted at any time and without notice by the Site Administrator if they consider that it contravenes the exceptions listed above.

 

Personal data

For all information concerning the processing of personal data by the Site Administrator, please refer to the personal data protection policy.

 

Liability

1) Responsibility of the user

All hardware and software required to access and use the site are the sole responsibility of the User, who is therefore solely responsible for the correct operation of his/her equipment and Internet access.

It is the user's responsibility to take all appropriate measures to protect their own data, computer systems and/or software from contamination by viruses.

Users are solely responsible for their use of the site.

The User is liable for any damage he may cause to the Site Administrator as a result of non-compliance with the T&C

The User expressly waives any claim or legal action relating to such damages.

The User undertakes to inform the Site Administrator immediately, by any means, of any error, fault, or irregularity in the use of the Site, via the contact form, as soon as he/she becomes aware of it.

In order to respond to a security alert (anti-virus check, etc.), at the request of an authority (administrative, judicial or any other authorised authority), or to an alert from another User, the Site Administrator reserves the right, where applicable :

·         To retain, for evidence purposes, any information that does not comply with the rules set out in the G.C.U. ;

·         To keep, for purposes of proof, all logs, connection traces or data of a personal nature or otherwise proving the imputability to the User of the behaviour or actions in question;

·         To modify, reject and/or remove access to any information that does not comply with the rules set out in these T&C

2) Responsibility of the Site Administrator

The Site Administrator shall use all reasonable means at their disposal to ensure quality access to the Site and secure access, consultation and use of the Site in accordance with the rules of Internet usage.

The Site is accessible 24 hours a day, 7 days a week, except in the event of force majeure or the occurrence of an event beyond the control of the Site Administrator, resulting from causes beyond their control, and subject to any breakdowns, maintenance work and updates necessary for the proper operation of the Site.

They cannot be held responsible for any malfunction of the network and/or servers or any other event beyond their control, which may prevent or impair access to the Site.

They reserve the right to interrupt, temporarily suspend or modify without notice access to all or part of the Site in order to carry out maintenance or for any other reason, without the interruption giving rise to any obligation or compensation.

They shall not be liable for any damage caused by :

·         Use of the Site by the User in a manner that does not comply with these G.C.U. and with the regulations in force;

·         The configuration of the User's computer allowing him/her to identify him/herself automatically and thus allow any third party to use the Site with his/her account or by usurping his/her identity. Consequently, to limit this risk, the User is invited to secure access to his/her account (deletion of cookies and automatic identification, etc.).

Users are informed that cookies may be stored on their computer when they visit the Site. A cookie is a text file that does not allow the User to be identified but is used to record information relating to the User's browsing on the Site. These cookies are used to analyse the number of visitors to the Site and to measure the audience in order to improve the quality of the Site. Please refer to the paragraph on cookies in the confidentiality policy.

Hypertext links

Outgoing hypertext links are set up on the Site to other external resources on the Internet, but also from external resources to the Site, whether these be links to the sites of the Site Administrator's entities or to the sites of any other third parties.

These various links may not be considered as constituting an offer of services or products, or a recommendation, advice or commercial solicitation of any kind whatsoever.

The Site Administrator declines all responsibility for the content and use that may be made by any third party of the information appearing on all other sites.

Similarly, the Site Administrator declines all responsibility for the consequences of technical failures in connection with these links.

The User therefore agrees not to hold the Site liable for the content and resources of these outgoing hypertext links.

The creation of hypertext links to pages or documents published on the Site is authorised if the links guarantee the possibility of identifying the origin of the document.

The User must inform the Site Administrator in advance via the contact form.

The Site Administrator may, at any time, require the removal of hypertext link(s) established by any person to the Site from an external site, if this site infringes the image of the Site Administrator or, more generally, the activities and objectives of the Site.

 

Telecommunications security and integrity

The security and integrity of Internet communications cannot be guaranteed.

The Site Administrator declines all responsibility for the consequences of technical failures in connection with the Site, in particular with regard to any difficulty in accessing the Site or any interruption in the broadcasting of the Site.

 

Protection of IT systems

Articles 323-1 et seq. of the Criminal Code punish attacks on automated data processing systems, in particular:

·         Fraudulently accessing or remaining in all or part of an automated data processing system;

·         Obstructing or distorting the operation of such a system;

·         Fraudulently introducing data into such a system or fraudulently deleting or modifying the data contained therein.

 

Duration

These T&C apply throughout the User's browsing and access to the Site and throughout the User's use of the Service.

The User is hereby informed that the T&C may be updated at any time in accordance with the conditions set out above.

Applicable law - jurisdiction

The Site, whose official language is French, is governed by French law and any dispute arising from the use of the Site, in the absence of an amicable agreement, is subject to the exclusive jurisdiction of the French courts.
